What is embezzlement?

Embezzlement is defined by NRS 205.300 as any bailee of any money, goods or property, who converts it to his or her own use, with the intent to steal it or to defraud the owner. A bailee is defined simply as any person who has temporary ownership of the money or property or has been entrusted with holding/carrying the money or property. To put it in simpler terms, any person is guilty of embezzlement if he/she has been entrusted with money and/or property and has then stolen the money and/or property.

What is the difference between embezzlement and larceny?

The difference between embezzlement and larceny is that with larceny, the person who stole the property never had temporary ownership or was never entrusted with the property. In contrast, with embezzlement, the person who stole the money and/or property did have temporary ownership or was entrusted with the property before stealing it.

Penalties and punishments for embezzlement charges in Nevada:

As stated by NRS 205.300 (1), the punishments and penalties for embezzlement are the same as those for larceny.

If the money and/or property embezzled is valued under $650, you are guilty of a misdemeanor and will be ordered by the court to pay restitution.

If the value of the property involved in embezzlement is more than $650 but less than $3,500, you are guilty of a category C felony and shall be punished:

  • A minimum term of not less than 1 year and a maximum term of not more than 5 years in a state prison; and
  • A possible fine of not more than $10,000.

If the value of the property involved in the embezzlement is $3,500 or more, you are guilty of a category B felony and shall be punished:

  • A minimum term of 1 year and a maximum term of 10 years in a state prison;and
  • A fine of not more than $10,000.

In addition to any other penalty, you will be required to pay restitution.

It is important to note that the value of all goods or money stolen in separate acts of embezzlement will be combined if:

  • The separate acts were committed against the same person within 6 months before the offense;
  • None of the individual acts is punishable as a felony; and
  • The cumulative value of all the money, goods, property and effects misappropriated is sufficient to make the offense punishable as a felony.
