What constitutes trafficking of a controlled substance in Nevada?
Nevada breaks down the law for trafficking of a controlled substance by the type of substance the individual possessed. It is important to note that Controlled substances classified under Schedule I and II can only apply to trafficking charges.

- Mescaline

Common Schedule II drugs include any of the following:
- Cocaine
- Codeine
- Morphine
- Opium
- Barbiturates
- Adderall
Penalties for trafficking of marijuana or concentrated cannabis charges in Las Vegas:
If the quantity is 50-1,000 pounds of marijuana OR 1-20 pounds of concentrated cannabis, you are guilty of a category C felony and will be punished:
- A minimum term of 1 year and a maximum term of 5 years in a state prison; and
- A fine of no more than $25,000.
If the quantity is 1,000-5,000 pounds of marijuana OR 20-100 pounds of concentrated cannabis, you are guilty of a category B felony and will be punished:
- A minimum term of 2 year and a maximum term of 10 years in a state prison; and
- A fine of no more than $50,000.
If the quantity is greater than 5,000 pounds of marijuana OR greater than 100 pounds of concentrated cannabis, you are guilty of a category A felony and will be punished:
- For life in a state prison with the possibility of parole, with the eligibility for parole when a minimum of 5 years has been served; or
- For a definite term of 15 years, with the eligibility for parole when a minimum of 5 years has been served; and
- A fine of no more than $200,000.
Penalties for trafficking a schedule i substance charges in Las Vegas:
If the quantity is 4-14 grams, you are guilty of a category B felony and will be punished:
- A minimum of 1 year and a maximum of 6 years in a state prison; and
- A fine of no more than $50,000.
If the quantity is 14-28 grams, you are guilty of a category B felony and will be punished:
- A minimum of 2 year and a maximum of 15 years in a state prison; and
- A fine of no more than 100,000.
If the quantity is 14-28 grams, you are guilty of a category B felony and will be punished:
- A minimum of 2 year and a maximum of 15 years in a state prison; and
- A fine of no more than 500,000.
Penalties for trafficking a schedule ii substance charges in Las Vegas:
If the quantity is 28-200 grams, you are guilty of a category C felony and will be punished:
- A minimum term of 1 year and a maximum term of 5 years in a state prison; and
- A fine of no more than $50,000.
If the quantity is 200-400 grams, you are guilty of a category B felony and will be punished:
- A minimum of 2 years and a maximum of no more than 10 years in a state prison; and
- A fine of no more than $100,000.
If the quantity is 400 grams or more, you are guilty of a category A felony and will be punished:
- For life in a state prison with possibility of parole after a minimum of 5 years have been served; or
- For a definite term of 15 years, with eligibility for parole beginning when a minimum of 5 years have been served; and
- By a fine of no more than $250,000.
Defenses to trafficking of controlled substances charges:
- Illegal search and seizure. If the drugs were obtained illegally, either without probable cause or without a search warrant, the evidence should excluded.
- The drugs were not in your possession. If you did not know that the drugs were there and belong to someone else, you should not be charged with trafficking of a controlled substance.
