When You’re Pulled Over for a DUI

It’s never a good feeling to see those flashing red and blue lights in your rearview mirror.  And if you’re hoping someone else is being pursued, your stomach may drop when you realize that it’s you that the officer is interested in. It’s bad enough to be pulled over—but the panic really escalates if you’ve had a drink or two before getting behind the wheel.  What should you do?

Keep Your Wits About You 

Obviously, you’re going to need to pull over rather than try to outrun the patrol car. Do so as smoothly as possible, using your signal to indicate your intentions. Once safely on the side of the road, turn the ignition off, roll down your window, and prepare to talk to the officer with your hands visible. As the officer approaches, remind yourself that a little courtesy goes a long way. Comply with the officer’s request for your license, registration and insurance cards. If you are questioned about where you’ve been, where you’re going, or whether you’ve been drinking, politely assert your right to remain silent. If things seem to be escalating, tell the officer you’d like your attorney present for any further questioning.

Do You Have to Consent to a Breathalyzer or Blood Test? 

In Nevada implied consent laws require drivers to comply with an officer’s request to administer a field sobriety test of a test to determine your blood alcohol level. Failing to cooperate with a blood test or breathalyzer will likely lead to your arrest. It could also lead to the revocation of your drivers’ license, the installation of an ignition interlock device in your vehicle, and potential charges.  Presumably you were pulled over for some sort of recklessness, so even if you can’t be charged with DUI, reckless driving could be its own nightmare. Additionally, it’s possible for police to obtain a warrant to get the blood drawn.

If You’re Arrested 

In the event the officer chooses to arrest you, remember to be compliant, and request the presence of an attorney before answering any questions. You could be facing some severe consequences, including increased insurance rates, DUI school, community service, fines, and potentially time behind bars. A conviction can definitely have long-term consequences, since you will have a permanent blemish on your record, which could affect employment opportunities and more.
